1. Agreement to Terms

By using the SurfTap Apple Watch app ("the App") or the SurfTap website ("the Site"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App or the Site.

2. About SurfTap

SurfTap is a free Apple Watch app for quick surf checks, tides, and surf session tracking. There's no account to create and no paid tier. The App needs Wi-Fi or cellular to update conditions. We may change, pause, or discontinue features, the App, or the Site at any time without notice.

3. Safety First

SurfTap's surf, weather, and tide information is for general informational purposes only. It is not intended for navigation, rescue, or any situation where inaccurate data could result in harm.

Safety Notice: Ocean conditions can change quickly and can be dangerous. You are responsible for your own safety and decisions in the water. Always verify conditions with local authorities, trust your eyes on the sand, and surf with a partner where lifeguards are on duty. Never rely solely on any app for decisions involving your safety or the safety of others.

4. Session Tracking & Health Metrics

Wave counts, ride stats, distances, speeds, heart rate, and calories are estimates based on GPS and your watch's sensors. They can be inaccurate, especially in the water, where GPS signals are less reliable. SurfTap is not a medical device and is not intended to diagnose, treat, or monitor any health condition.

5. Location, Health & Your Data

SurfTap uses your location to find conditions near you and to record surf sessions, and can save completed sessions to Apple Health with your permission. Our Privacy Policy explains exactly what is collected, where it is stored, and what is shared.

6. Data Accuracy & Availability

Surf, weather, and tide data comes from StormGlass.io, and place names and spot search results come from Apple. While we do our best to surface accurate, current conditions, we make no guarantee of accuracy, completeness, or timeliness. Data may sometimes be unavailable, for example during a provider outage or after the App's daily refresh limit is reached. The ocean writes its own rules.

7. Intellectual Property

The SurfTap name and logo, the Site's design, and the images, videos, graphics, audio, and text on the Site are the property of SurfTap or its licensors and are protected by copyright and other intellectual property laws. Some visual and audio materials have been licensed from third-party providers under paid licenses that grant commercial usage rights.

You may not copy, reproduce, distribute, or modify this content without written permission from SurfTap, except as follows:

Surfboard icons: The free surfboard icon set may be used in personal or commercial projects under the license included in the download. Please don't sell or redistribute the icons or claim them as your own, and credit SurfTap if you share them.
Source code: When SurfTap's source code is published, it will be available under the MIT License, which governs your use of the code.

8. Third-Party Services

SurfTap relies on services from StormGlass.io and Apple, which have their own terms. If you download SurfTap from the App Store, Apple's standard Licensed Application End User License Agreement also applies.

9. Disclaimer & Limitation of Liability

The App, the Site, and their content are provided "as is" and "as available," without warranties of any kind. SurfTap makes no guarantees about accuracy, reliability, or availability.

To the fullest extent permitted by law, SurfTap is not liable for any injury, loss, or damages arising from your use of the App, the Site, or their content, including decisions you make about surfing or entering the water.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version on this page and update the "Last Updated" date. Continuing to use SurfTap after a change means you accept the updated Terms.
